This case involves a motor vehicle accident resulting in injury. The driver was reportedly driving on a busy street, and while in lane, he attempted to merge out of the lane, not seeing a plastic lane divider. He collided with the lane divider causing him to lose control of the vehicle and crash into a light-pole and the plaintiff who was on the sidewalk. The defense is contending that the city is at fault because it did not properly place or maintain the divider, causing the vehicle to lose control. Plaintiff’s counsel seeks an automotive engineer to perform a visual inspection of the vehicle in question, and to determine how the accident may have occurred.
