Economist Expert Determines Lost Wages for Child With Lead Poisoning

This case involves a toddler who developed severe behavioral problems as a result of lead exposure. A house, built in the 19th century, was rented out to the family of the plaintiff in the early 2000’s. The couple had a child, and early in the child’s life, the family started noticing severe behavioral problems. He was very aggressive, had ADD and ADHD, and is in a special learning program. When the family took the child in to test for lead paint exposure, it revealed levels of 26 mcgs present in the child. The national cutoff is 5 mcg/DL. The defendant did not disclose information concerning lead paint in the house and claimed he had no idea of the laws and potential issues with lead, although he has had experience renting numerous other houses. Defendant is also a civil engineer with experience in managing buildings and construction sights, and also owns a road striping company. The plaintiff alleges this damage will hinder the child’s ability to maximize his future earnings potential, and also result in additional costs from therapy and counseling.
